Goldback – Detailed Terms & Conditions
- By participating in this Campaign (as defined hereunder) or by deriving any benefits thereunder, 1) You /Paytm user (“Participant”) hereby confirm, acknowledge and agree that You, have read, understood and agreed to be legally bound by and abide by the below Terms & Conditions (T&C). If you do not agree to these T&C, please do not participate in this Campaign and 2) You agree to abide by all the T&C of Gold Accumulation Plan Account (GAP account) mentioned at https://paytm.com/offer/paytm-gold/goldbackdetailed, including terms of gold accumulation, transfer, sales or redemption and the like mentioned at https://paytm.com/about-us/our-policies/#tandc .
- One97 Communications Ltd, (“Paytm” - which term shall include its permitted assigns) solely reserves the right to amend, modify, add or change these T&C and/ or terminate, stop, withdraw or discontinue this Campaign or Goldback Promo Code or the benefits bestowed thereunder without any further notice or liability whatsoever. You are hereby advised to visit the Website at https://paytm.com/about-us/our-policies/#tandc periodically to keep yourself updated and informed.
- The gratifications offered under this Campaign are solely sponsored and distributed by Paytm to the Winner(s) (announced later) of this Campaign who are Paytm registered users, purchasing gold on www.paytm.com or paytm mobile app (“Paytm Platform”).
- For avoidance of the doubt 1) Campaign shall mean the campaign as detailed under these T&C (“Campaign”); 2) the promo code shall mean any Goldback Promocode and 3) the gratification shall mean Goldback equal to the amount mentioned hereunder.
- Beneficiaries under the Campaign shall be subject to the terms and conditions governing GAP Account Management for Goldback Beneficiaries set out below.
Part A
- Paytm reserves the right to disqualify any transaction or discontinue Campaign any time without notice or liability of whatsoever nature. Any Participant(s) providing any incorrect information or concealing/ withholding any information from Paytm will be disqualified from participating in Campaign without any notice or liability.
- All decisions by Paytm regarding the Campaign shall be final and binding.
- Cancelled order shall not be counted for the purpose of the Campaign
- If the winner fails to comply with the herein set requirements her/his right to win the gratification is hereby waived off and gratification shall be forfeited without notice or liability of whatsoever nature.
- Without prejudice to the foregoing, under no circumstance shall the winner(s) of the Campaign be entitled to redeem any category of gratification for cash.
- This Campaign is being made purely on a “best effort” basis and participation of eligible Participants is voluntary, and subject to the applicable laws, rules and regulations including taxes laws, TDS deduction and guidelines/ directions issued by any authority from time to time or any other terms and condition as may be applicable to specific gratification.
Part B
- Participation in the Campaign is open only for the Indian citizens of 18 years of age or above during the Campaign Period, provided participants are Paytm’s registered users in India.
- The participants of the state of Tamil Nadu and wherever else such campaign is prohibited by law, shall not be entitled to participate in this campaign. Where the campaign is declared invalid or illegal by the court of competent jurisdiction or applicable law, the campaign shall not applicable and /or stands withdrawn forthwith in such jurisdiction.
- Paytm shall not be liable to Participants or any third party, for any direct and or indirect losses, damages or claims of whatsoever nature including incidental, special, punitive or consequential damages, loss of profits, technical errors, snag or delay in communication and the like. All warranties of any kind whatsoever, whether express or implied, are hereby expressly disclaimed including, meeting of the participant's requirements or aspirations, or the quality, merchantability, fitness for particular purpose of any goods, services, benefits or awards or Product or gold acquired or obtained through the Campaign.
- The participant shall indemnify Paytm from and against any and all claims (including all third party claims), losses, or damages, and costs (including attorney’s fees and court costs) incur or suffer by Paytm, as a result of any act or omission of the Participant in relation to or arising out of the Campaign and or this T&Cs for any other reason whatsoever.
- This Campaign is subject to force majeure events and circumstances including natural disasters, war, act of terror, political unrests, technical snags, Act of God, change of laws or any circumstance beyond the control of Paytm. Paytm shall not be liable for any delay or damages or act or omission caused to this Campaign or Participant(s) due to force majeure event.
- Paytm reserves all the rights to provide any amount/voucher/any other gratification equivalent to the cost of the Goldback/Gratification.
- Failure by Paytm to enforce any of their rights at any stage does not constitute a waiver of those rights. The gratification(s) under this Campaign is neither assignable nor transferable under any circumstance, and no request shall be entertained by Paytm for such transfer.
- Apart from Gratification, the winners or participants shall have no other rights or claims against Paytm. Paytm’s liability in contract, tort or otherwise (including negligence) howsoever arising out of or in connection with the Campaign shall not in any manner exceed, in total, regardless of the number of claims, in respect of all matters, the amount or value of Goldback or Rs.5000/- whichever is lower.
- Any dispute arising out of this Campaign and T&C may be resolved amicably through negotiations. In the event, amicable settlement fails such dispute shall be referred to Mediation to be held New Delhi in English.
- The Campaign & T&C shall be subject to Indian laws and the exclusive jurisdiction of the Courts in New Delhi.
GAP Account Management for Goldback Beneficiaries:
- Your GAP account will be classified as dormant if no transactions (deposits, withdrawals, or purchases) have been made for a continuous period of three (3) years from the date of last transaction on the Paytm mobile app. Paytm shall be under no obligation to notify the Goldback beneficiaries in this regard.
- If no activity is recorded in the GAP account for an additional six (6) months following its classification as dormant, a service fee will be applicable.
- The service fee shall be charged at INR 18 or 1.0% of the total gold balance stored in the dormant GAP account (whichever is higher) per calendar quarter and shall be debited against the balance lying in the said GAP account on the last day of the calendar quarter. The aggregate service fee shall not exceed the value of gold balance stored in the dormant GAP account and upon exhaustion of the stored gold balance, the GAP account shall be deemed closed/de-activated.
- Paytm shall not be held liable for any reduction in the value of gold balance due to the deduction of service fees.
- As Goldback beneficiaries, you acknowledge that it is your sole responsibility to monitor your account activity and maintain an active status in your GAP account to avoid service fees.
- Paytm reserves the absolute unqualified right to revise, modify, or discontinue these GAP Account Management Terms and Conditions at its sole discretion without prior notice, subject to applicable laws.
- To reactivate a dormant GAP account, beneficiaries may be required to update KYC, complete their identity verification and initiate a transaction on the Paytm mobile app. Paytm reserves the right to impose additional conditions or verification measures for reactivation at its discretion.
- Paytm reserves the absolute right to waive, reduce, or modify service fee for specific beneficiaries or users at its sole discretion, without any obligation to provide justification or prior notice.
- Paytm retains full discretion over the classification, management, and imposition of charges on dormant accounts.
- You agree to indemnify and hold Paytm harmless against any claims, losses, or disputes arising from dormancy classification, service fee deductions, or any other related terms and conditions.
- Paytm is not responsible for any financial losses on account of service fee or otherwise, fluctuations in gold value, or other external factors that may impact the dormant GAP accounts.
- The gold balance/equivalent moneys will be held in “trust" for the Goldback Beneficiaries and until the balances are redeemed or exhausted, OCL ought not to block any redemptions on account of GAP Dormancy
