Paytm Loyalty Program

Terms & Conditions (TnCs)

PART A

Enrolment:

Paytm users will be auto enrolled in the Paytm Loyalty Program based on their transaction history using Paytm Platform.
Membership to the Paytm Loyalty Program does not require any separate registration or payment of membership fee.

Cashback Points:

Cashback Points are earned by the member for successful payments made using Paytm. For further details please refer to the detailed FAQ’s https://paytm.com/offer/consumer-loyalty/paytm-pro-faqs
Cashback Points shall not be issued in the case of a refund/cancellation of a transaction.
Cashback Points are auto credited anywhere between 24 hours to 15 days of undertaking a successful transaction and get accumulated in the member's Paytm account.
Cashback Points can be used for redeeming the rewards catalog for deals and offers.
Cashback Points cannot be redeemed for cash and are being issued at the sole discretion of Paytm.
Cashback Points cannot be reversed or canceled once redeemed.
Cashback Points are valid for one year from the month of issuance.
Cashback Points cannot be reinstated or the validity cannot be extended on expiry of the one year time period.
Cashback Points cannot be redeemed once expired.
Cashback Point shall be issued at the sole discretion of Paytm.
Cashback Points cannot be sold, bought, transferred or exchanged and can be redeemed only on the Paytm Platform.
Pro Max, Pro and Classic members will earn 3, 2 and 1 Cashback Points respectively for every Rs. 100 spent or transferred using Paytm. The minimum transaction value to start earning Cashback Points is Rs. 100.
Members can earn Cashback Points as per the following limits:
Maximum 2,000 Cashback Points can be earned per transaction. For UPI money transfer and transactions on select small merchants (eg: kirana stores) earning is capped at 500 Cashback Points per transaction.
Maximum 5 transactions per day will be gratified with Cashback Points for eligible transactions
Maximum 5,000 Cashback Points per month can be earned for eligible transactions
Maximum 2 transactions per merchant per day will be gratified with Cashback Points.
Maximum 2 UPI money transfer per payee per day will be gratified with Cashback Points.
For all eligible transactions, a maximum of 40, 20 and 20 transactions per month is eligible for earning Cashback Points for Pro Max, Pro and Classic members respectively.

14. All transactions on Paytm app including UPI money transfer, merchant transactions & Fastag recharge are eligible, excluding:

Paytm Payments Bank Wallet to bank
NEFT/RTGS/IMPS money transfers
All Net banking & debit card transactions
UPI & Paytm Payments Bank Wallet payments on 3rd party payment gateways
Transactions using Paytm Payments Bank Wallet

Program Tiers:

Paytm Loyalty Program offers 3 tiers - Pro Max, Pro and Classic
Members will be upgraded to Pro or Pro Max tiers on meeting the criteria outlined under the Paytm Loyalty Program.
In case the member is unable to meet the criteria to retain the current tier, they will be moved to the next lower tier applicable.
Paytm reserves the right to downgrade the member’s tier, without prior notice.

Deals & Offers:

As a part of Paytm Loyalty Program, members across tiers will be offered deals and offers in the redemption catalog.
Certain deals and offers will be available exclusively for the Paytm Pro Max tier members.
Deals and offers are available to the Paytm Loyalty Program members on a best effort basis. Paytm will not be liable incase of non-availability of any item due to stock out.

PART B

TERMS AND CONDITIONS GOVERNING THE PAYTM LOYALTY PROGRAM :

This Paytm Loyalty Program (“Program”) is conceptualized, owned, hosted and operated by One97 Communications Ltd., a company which owns and operates an online marketplace on the website located at the URL:‘www.paytm.com’ and Paytm mobile application, Paytm IVR and Paytm WAP (hereinafter “Paytm Platform”), having its registered office at 136, 1st Floor, Devika Tower, Nehru Place, New Delhi - 110019 and corporate office at Plot no. H-10, Tower D, One Skymark, Sector 98, Noida (UP) 201301(hereinafter “One97” or “Paytm”).
This document is an electronic record in terms of the Information Technology Act, 2000 and Rules there under as applicable. This electronic record is generated by a computer system and does not require any physical or digital signatures.

These terms and conditions shall be applicable to all members of the program (“Member” or “You” or “Your” as the case may be). For the purposes of these terms and conditions, wherever the context so requires “Member” “You” or “Your” shall mean any natural person, being of at least 18 years of age, citizen of India, not under any legal disability nor prohibited from entering in any contractual relationship; and who being a Member has participated in this Program.
By participating in the Program, the Member agrees to be legally bound to the Terms and Conditions including but not limited to various Paytm policies as made available on its website or in any other mode. Member(s) confirm and acknowledge that they have read, understood and agreed to conform to these terms and conditions (“T&C”). If Member(s) do not agree to these T&C they will not be eligible to participate in this Program.

You agree that You are entering into this program of Your free will and consent and nothing herein establishes an employer-employee, servant master relationship between You and Paytm

You warrant that You have read, understood and agreed to confirm to these Terms and Conditions and warrant the accuracy, truthfulness and currency of all information that You have submitted and Paytm disclaims any and all responsibility connected therewith.

Paytm reserves the right, at any time, to unconditionally disqualify any Member who tampers with or who in any way abuses the process or Terms and Conditions of the Program. Failure by Paytm to enforce any of the Terms and Conditions in any instance shall not be deemed to be a waiver of that Term and Condition and shall not give rise to any claim by any person. Member(s) understand and agree that Paytm may disqualify, suspend, block or terminate the participation of any Member at any stages of the Program for any reasons where it is found by Paytm (i) that participation by the Member is not bona fide; (ii) he has participated in the Challenge and paid charges towards it using the amount of wrongful/duplicate refund or waiver and/or (iii) participation of the VIL Subscriber is not in the interest of the Challenge. The decision of the Organizer or VIL shall at all times be binding and final.

Mere membership of the Program shall not entitle You to any benefits that are not specifically mentioned. No other person or agent can claim the benefits on behalf of the Member.
Without prejudice to the foregoing, under no circumstance shall the Member of the program be entitled to redeem any category of benefit under the Program for cash. Paytm , at its sole discretion, shall not provide a cash alternative to any of the benefits offered in the Program
The Participants and You hereby irrevocably authorize Paytm to use the data/information gathered during the Program in respect of the Participant (including but not limited to name and photograph) in any of its communications including marketing promotions and advertisements.
Paytm shall not be responsible for any claims from any Participant of the Program or any third party arising out of any failure(s) which is beyond the reasonable control of Paytm. Without limiting the generality of the foregoing, Paytm shall not be responsible for any claims arising out of technical failures before, during or after the completion of the Offer including but not limited to any technical failures in the mobile/computer/laptop/any device connectivity, delay in sending or receiving the SMS for participating in the Offer, any type of delay, any action that has been initiated, actioned or completed through his/her mobile phones/electronic device/computer/laptop/tablet, failure of servers or any type of failures arising out of technical snags or resultant inability of the Participant(s).
Any Member providing any incorrect information, concealing or withholding any information from Paytm with intent to participate in the Membership will automatically be disqualified from becoming a Member. Such act of providing incorrect information, concealing or withholding any information, including without limitation incorrect declaration of information relating to name, age, identity, address, any other information provided by You, shall entitle Paytm to disqualify him/her without any further intimation.
MODIFICATION AND WITHDRAWAL OF TERMS AND CONDITIONS
Paytm reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify these Terms & Conditions of the Membership or any part thereof at any time during the period of the Membership and without prior notice to You, including the eligibility criteria, the benefits and/or offers (by whatever name called) at its sole discretion as may be required in view of business exigencies, authorities, changes by regulatory authority and/or statutory changes and for other reasons beyond its control.
If Paytm modifies these Terms, the latest revised version of the Terms and Conditions shall be effective and binding on the Members from the time of its posting on the Paytm.com - Terms & Conditions. You are therefore advised to check these websites regularly for any update(s) or amendment(s) made to these Terms and Conditions and in the event the modified or amended Terms and Conditions are not acceptable to You, You should discontinue participating in the Challenge. Your continued participation in the Challenge will constitute Your acceptance of the latest revised Terms and Conditions.

DISCLAIMERS

You agree that this Program is being made purely on a “best endeavour” basis and subject to acceptance of these Terms and Conditions. Your participation in the Challenge is voluntary and You expressly agree to participate at your sole risk. VIL and the Organizer shall not be responsible for any loss, injury or any other liability to any Participant arising due to participation in the Challenge.
To the extent you choose to participate in this Membership, you do so at your own volition and You shall remain responsible for compliance with the Terms and Conditions herein, any applicable laws, including but not limited to applicable local laws. You agree not to hold Paytm, its officers, directors, employees, affiliates, and agents or representatives liable for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by You or third party, in connection with the Membership or arising otherwise.
Subject to any applicable law (a) All warranties of any kind whatsoever, whether express or implied, are hereby expressly disclaimed by Paytm including, but not limited to, meeting of the Member’s requirements or aspirations, timeliness, technical snags including network problems or system error, the delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any goods, services, benefits or awards acquired or obtained through the Membership or any transactions effected through the Membership; (b) The Member expressly agrees that his/her participation in the Membership offered by Paytm is at the Member’s sole risk and is governed by the Terms and Conditions herein; and (c) No advice or information whether by representations, oral, written or pictorial derived from the Website or through the Membership shall be construed to mean the giving of any warranty of any kind by Paytm.
Paytm shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of Paytm.
The Member shall indemnify and keep indemnified Paytm and its officers, directors, employees, and affiliates harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs (including attorney’s fees and court costs) which Paytm may incur, pay or become responsible for as a result of breach or alleged breach of the representations or obligations of the Member under the Terms and Conditions, any failure by the Member participating in the Program to comply with applicable law, any infringement of intellectual property rights of the Paytm and any third party claim in respect of misuse of any information of a third party. Paytm shall have the right to defend itself, pursuant to this Clause, at the cost of the Member.
Neither shall Paytm nor any of its group entities or affiliates, their respective directors, officers, employees, vendors, representatives, be liable for any action, claim, demands, losses, cost, charges, expenses or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life) or incurred or claim to suffer, by a Member and/or any third party, directly or indirectly, by use or non-use of the benefits offered or on account of their participation in this Program.
Any attempt by a Member to deliberately undermine the legitimate operation of the Program is a violation of laws and should such an attempt be made, Paytm reserves the right to seek damages from any such Member to the fullest extent permitted by law.
Paytm does not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the Member(s).
Paytm and its officials including their directors, officers, partners, employees, consultants and representatives are under no obligation to render any advice of service to any Member in respect of the Program.
INTELLECTUAL PROPERTY RIGHTS
You, the Member , acknowledge and agree that all copyright and trademarks and all other intellectual property rights in the SMS content, WAP Link, Website and all material or content related to the Challenge shall remain, at all times, owned by Paytm or its respective owners. All material and content contained in this Website is made available for your personal and non-commercial use only. Any other use of the material/ content on this Website, WAP Link or any information disseminated by SMS or any other means of communication is strictly prohibited.
Nothing in the Program shall affect any intellectual property rights of Paytm or any of their affiliates in any product or service made available on the Website.
By participating in the Program You confirm to abide by all intellectual and industrial property rights, including copyrights or trademarks belonging to Paytm and to any third party licensor of content to Paytm that is made available through the Program.
GENERAL TERMS AND CONDITIONS
By participating in this Program, You confirm that you have read understood and agreed to confirm to these Terms and Conditions; You also warrant the accuracy, truthfulness and currency of all information that you have submitted while participating in the Program;
Members shall fill and submit minimum required information for the Program (if applicable)
This benefits under this Program cannot be used in conjunction with any alternative benefit or promotion of a similar nature;
The provisions of this Program and any other promotional endeavour may not be used for any commercial purpose by the Member.
The Member may contact Paytm for any queries/complaints by visiting 24*7 "Help & support" section on Paytm App which will be answered within 4 hours. All concerns/queries must be addressed by the Member in writing to the Paytm directly. Further, any information that the Member may request in connection with the Program, may be provided by Paytm to the Member, at the sole and absolute discretion of Paytm , depending on the nature of the information requested within days,.. Paytm further clarifies that any information requested by any Member shall only concern that particular Member and under no circumstances will Paytm provide confidential information or information pertaining to other Member (s)
Upon participating in the Program, the Member confirms and waives the applicability of rules and regulations of the National Do Not Call Registry to the extent of receiving messages/calls in relation to this Program and shall imply their willingness to receive all promotional messages including without limitation daily updates on the benefits under the Program and engagement calls / SMS, promoting the new offers/benefits.
Force Majeure – This Challenge is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of Paytm (“Force Majeure Event”). Paytm shall not be liable for any delay or adverse effect caused to Participants as a result of a Force Majeure Event. Paytm shall intimate the suspension of the Program caused as a result of such Force Majeure Event to the Members(s).
Paytm may assign any or all of their rights under these Terms and Conditions to its affiliates or to any third parties without consent of the Participants.
Paytm shall be entitled to use, the details of the Member such as name, photograph, etc. for marketing purposes, if any. The Member also hereby agree to the same. Paytm may, at its discretion, choose not to disclose the identity of the Member to other Member(s) unless expressly mentioned herein. The Member also consent to the information stored in the servers of Paytm or its service providers, inside or outside India. Member's personal information will be stored and processed in accordance with Paytm’s Privacy Policy which is available at Paytm.com - Terms & Conditions
You agree that Paytm has no responsibility and liability with regard to the privacy, safety and security of any information (including personal information) that You may have to share independently with third parties.
This Program may contain factual references to the names of certain companies, products and individuals. Paytm makes no representation of having a business relationship or tie up with any such companies, products or individuals. All trade names shall continue to remain owned by their respective owners.
The winners understand and agree that Paytm, its owners and affiliates, shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), to a winner and/or any third party, directly or indirectly, by use or non-use of the benefit.
Any and all disputes shall be governed by the Laws of India and be subject to the exclusive jurisdiction of the Courts at New Delhi
