Part – A Offer Terms & Conditions (“T&C”)

1. By participating in this Offer, You (hereinafter referred to as “Participant(s)”) agree to be legally bound by and abide by the Terms & Conditions stated herein (T&C). Participant(s) confirm and acknowledge that Participant(s) has read, understood and agree to conform to these T&C. Participation in this Offer is conditioned on Participant(s) agreeing with the T&C’s mentioned herein. One97 reserves the right to amend, modify, change, add or terminate these T&C or discontinue this Offer without any further notice at its sole discretion and the same shall not be disputed by the Participant or any of the merchants.
2. The offer is valid for payments across all the app / website’s of the following Merchants where Paytm Wallet is integrated and Payment is made using Paytm Wallet:

   • Dominos Jubilant FoodWorks Limited 5% cashback upto Rs.100 on minimum transaction value of Rs.200 using Paytm Wallet Not Applicable
   • Box8 Poncho Hospitality Pvt. Ltd 15% cashback upto Rs.75 on minimum transaction value of Rs.250 using Paytm Wallet Not Applicable
   • Freshmenu Foodvista India Private Limited 15% cashback upto Rs.75 on minimum transaction value of Rs.350 using Paytm Wallet Not Applicable
   • Faasos Faasos Food Services Pvt. Ltd. 20% cashback upto Rs.100 on minimum transaction value of Rs.250 using Paytm Wallet Not Applicable
3. This Offer is valid from 1st March, 2018 at 00:00:01 hours till 4th March, 2018 at 23:59:59 hours (hereinafter referred to as “Offer Period”).
4. Steps to Participate in the Offer and Gratification:
   1. Participant(s) to make a minimum transaction of amount as stipulated above in clause 2 using Paytm Wallet on any of the merchant website / app mentioned above during the Offer Period to become eligible for participation in this Offer and get a chance to win an iPhoneX once during the Offer Period. There is no minimum transaction amount required to win iPhone X.
   2. In addition to a chance to win an iPhoneX, each Participant shall get the Cashback and/or free delivery as mentioned against each merchant referred to above.
   3. Participants need to apply promo code as stipulated above in clause 2 to get cashback/free delivery.
   4. One promo code can be applied only once by a user during the Offer Period.
   5. The Offer is only valid for “Qualified & Completed Payments”, which mean those payments which have neither been categorized as cancelled/ altered/ complained/ refunded by the Participant(s) or One97 making the payment or by the relevant merchant, nor have been categorized as unexecuted and Participant(s) shall not dispute the same.
   6. Terms for claiming IphoneX by the winner
      • One97 may announce Tentative Winner during the intermittent period of offer and the rest may be announced thereafter. One97 shall have the sole discretion over the selection process and the same shall not be challenged in any manner by any Participant(s) [including the Tentative Winner(s)/Winner(s)] and/or merchants.
      • The number of winner(s) selected shall be “Tentative Winners” who shall be contacted by One97 and confirmed basis qualification criteria, verification & submission of required documents as per the clause mentioned below. The Tentative Winner declared by One97 understands that he/she is not the Winner and his/her winning is subject to verification & confirmation by One97.
      • Post selection of “Tentative Winner”, One97 shall make three (3) attempts within 48 hours to contact such Tentative Winner on their registered Mobile Number/E-mail in the Offer to inform about the gratification and further process of claiming the gratification.
      • Post selection of Tentative Winners, each such Tentative Winner shall be required to provide adequate documents required for identification and for claiming the Prize from One97 within prescribed time limits provided in this regard, failing which such Tentative Winner shall be considered ineligible for being selected as Winner(s). Winner(s) shall be the term given to those Tentative Winners, who have submitted the required documentation and have complied with all the relevant clauses mentioned herein.
      • Final list of Winner(s) will be announced as per the timeline decided by One97.
      • Validity of winner selection will be within 30 days after the end of Offer Period (Including contacting with winners, document validation, Generate Promo code etc.) provided winners have all requisite documents as mentioned in sub-section (d) below.
      • Document should be provided by the winners within 48 hours of being contacted.
      • Post completion of the verification and other requisites, the promo code will be provided to the winner via email/call/sms which can be used on Paytm website / Paytm Mall Website / Paytm App / Paytm Mall App to purchase the iPhone X. The validity of Promo code will be 45 days from the date of issuance by One97 after completion of such period the promo code will lapse and stand forfeited.
      • The winner(s) of iPhone X will be provided a promo code each which can be used on Paytm app/website and or the website / application of Paytmmall to purchase iPhone X. As per the current tax regime in India, the promo code will be equivalent to 70% of price of iPhone X (30% amount will be deducted on account of TDS). Winner shall pay the 30 % (TDS) amount at the time of using the promo code against the iPhone X on Paytm website / Paytm Mall Website / Paytm App / Paytm Mall App to purchase the iPhone X .
   7. Winner shall be required to provide all the following documents for identifications and for claiming the IphoneX within 48 hours of them being notified:
      1. Address proof (Voter ID Card / Driving License / Passport / electricity bill not older than 3 months / Telephone bill not older than 3 months)
      2. Photo Id proof (Aadhar Card / Passport/Voter ID/Driving License),
      3. One passport size photo,
      4. Postpaid bill (for postpaid user) (additional document),
      5. PAN card copy self-attested,
5. Winner Selection & Gratification:
   1. One (1) participant will be selected from each merchant at the end of the Offer Period on random basis, from all the participants who undertake above steps during the Offer Period and will be eligible to get the chance to win an IphoneX along with cashback and/or free delivery as promised by each merchant mentioned above.
   2. Total six (6) winners will be selected in this Offer.
   3. A Participant shall be entitled to win iPhone X and / or receive cashback / free delivery only once during the Offer Period.
   4. The Winner must have a valid Paytm KYC verified account. If the Paytm account is not KYC verified, the Winner must submit KYC documents and get his/her account KYC verified.
   5. Cashback will be processed within 48 hours of the participant making transaction on the merchant app / website. Cashback may vary merchant to merchant.
   6. Employees of One97 (including their family members/relatives) and of their group companies, affiliate or associate companies, shall not be eligible for iPhone X as one of the gratification under this Offer. In case it comes to the knowledge of One97 that any Winner is an employee of One97 or any family member/relative of an employee of One97, One97 reserves the right to forfeit the gratification.
   7. One97 will select the Winner on the basis of randomized selection process during the Offer Period. One97 shall have the sole discretion over the selection process and the same shall not be challenged in any manner by any Participant(s) or the merchant.
   8. The Gratification/Prize as depicted in the banner/landing page is purely for illustrative purpose only.
6. Offer is being made purely on a "best efforts" basis and is valid for a limited period only. One97 reserves the right to withdraw the Offer and/or alter any of the terms and conditions of the Offer at any time without any prior notice to the Participants and/or merchant at its sole discretion and the same shall not be disputed by the Participants and / or the merchant.
7. One97 reserves the right to offer any amount/voucher/any other prize equivalent to the cost of the Prize/Gratification at its sole discretion.
8. Winner(s) may be notified by One97 on their registered Mobile Number/E-mail registered on Paytm Platform to inform about the gratification and further process of claiming the gratification.
9. Any failure on part of the Winner to comply with any T&C or the directions issued by One97 for claiming of gratification shall entitle One97 to forfeit the gratification(s) or roll the gratification over to the next eligible Winner, at its sole discretion.

Part-B Legal Terms & Conditions:

1. By participating in this offer, you agree to be legally bound by and abide by these terms & conditions. You confirm and acknowledge that you have read, understood and agree to conform to these terms and conditions. If you do not agree to these terms & conditions, please do not participate in this offer.
2. This offer is sponsored, organized and administered by One97 Communications Ltd., a company having its registered office at 1st Floor, Devika Tower, Nehru Place, New Delhi - 110019 and corporate office at B-121, Sector 5, Noida, UP 201301 One97 (hereinafter referred to as “One97”).
3. To participate in this offer, you should have a Paytm account / wallet holder in India (ii) should be of or above 18 years of age (iii) must be a resident of India;
4. You acknowledge and agree that all copyright and trademarks and all other intellectual property rights in the SMS content, Website, WAP/App portal, and all material or content related to the offer shall remain, at all times, owned by One97 and/or their respective owners. All material and content contained in this WAP/App portal/Website is made available for your personal and non-commercial use only.
5. Subject to any applicable law, all warranties of any kind whatsoever, whether express or implied, are hereby expressly disclaimed by One97.
6. In all matters relating the Cashback offer, the decision of One97 Communications Limited shall be final and binding in all respects
7. We reserve the right to modify/change / withdraw all or any of the terms applicable to the Cashback offer, without assigning any reasons or without any prior intimation whatsoever.
8. We reserve the right to disqualify any user from the benefit of the Cashback offer if any fraudulent activity is identified as being carried out for purpose of availing the benefits under the Cashback offer or by using Paytm website
9. In no event, the entire liability of One97 Communications Limited for any dispute arising in connection with the Cashback offer shall exceed the cashback amount that the user is entitled to under the said offer.
10. One97 Communications Limited in no event shall be liable for any incidental, consequential and financial losses/damages in any event whatsoever. You shall indemnify and keep indemnified One97 and their officers, directors, employees, customers, affiliates and agents harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs (including attorney’s fees and court costs) which One97 may incur, pay or become responsible for as a result of breach or alleged breach of your representations or obligations, fraud, misuse of your Paytm Wallet, any failure by you to comply with applicable law and any third party claim in respect of misuse of any information of a third party.
11. One97 Communications Limited shall not be liable for any claims or grievances’/ defects/deficiencies solely attributable to the online partner’s to whom the payment is made/to be made (ii) any claims arising due to Force Majeure events or situations beyond its reasonable control.
12. Tax liability, if any, will be borne by user
13. This offer is being made purely on a “best effort” basis. Users are not bound in any manner to participate in this offer and any such participation is purely voluntary.

15. All issues / queries / complaints / grievances relating to the offer, if any, shall be addressed to customer support on [email protected].
16. All disputes shall be governed by laws of India and shall be subject to exclusive jurisdiction of the courts at Delhi
